In the state of Texas, there is no “cut off” or “construction” date that allows for a building construction areas not to be tested for asbestos prior to disturbance from renovations. A pre-renovation asbestos survey is required prior to any disturbance, regardless of construction date, unless a licensed architect or engineer can issue a statement saying that he/she has reviewed all MSDS sheets for all the existing building materials and that he/she is familiar with the construction history of the work area and certifies (with a stamp) that there is no asbestos-containing material that will disturbed during the renovation activities.
Chances are, you will not find an architect or engineer to sign that statement so a pre-renovation survey is to be performed.
